Discussion summary: “How to facilitate cross-border concentrations in Europe?”

17 March 2014 par dans Competition, Publications

Conference with Fabien Zivy (Court of Justice of the European Union), Nadine Mouy (French Competition Authority), Jerome Philippe & Maria Trabucchi (Freshfields Bruckhaus Deringer) and Laurent Benzoni (Tera Consultants).

Summary of the debate: “How to facilitate cross-border concentrations in Europe?”

The Eurotunnel case, during which the French Competition Authority and the Competition Commission analyzed in parallel the concentration between Eurotunnel and assets of SeaFrance, gave rise to divergent positions of the two national authorities. This is an opportunity to open a debate on the European treatment of cross-border mergers, especially those that do not exceed the thresholds of regulation by the European Commission.
